Representative Services

Here are the most important standard services we provide:

  • Filing the will (if any) with the Superior Court.

  • Identifying property interests (e.g., advising you how to transfer joint tenancy property, retirement benefits, insurance, and other non-probate assets).

  • Drafting legal notice of death and mailing to beneficiaries and heirs.

  • Drafting petition for probate and filing it with the Superior Court.

  • Obtaining independent powers for personal representative.

  • Obtaining a fidelity bond, if necessary.

  • Securing admission of will (if any) to probate.

  • Obtaining letters of administration for administrator.

  • Arranging for publication of legal notice which cuts off creditors' claims after four (4) months.

  • Preparing inventory and appraisal and filing it with the Superior Court.

  • Helping arrange for sale of real estate property, if requested by personal representative.

  • Advising personal representative whether income taxes or estate taxes are due.

  • Helping prepare final accounting for court, if required.

  • Petition for final distribution of estate and obtaining Court order of distribution.
